Terms & Conditions

Please read these Terms and Conditions (“Terms”) carefully before using this website.

Base, 1 Victoria Road, Parkstone, Poole, Dorset, United Kingdom, BH12 3BA t/a Base Space (“BASE”, “we”, “our” or “us”) and in these terms, “you” or “your” shall mean our customer who shall benefit from our Services.

Below are the terms and conditions on which Base shall provide its fitness, Pilates and personal training services (the “Services”).

Before you agree to these Terms and whether we shall provide Services to you and/or carry out the Health Check, ("Health Check", "Custom Info Fields" or "Intake Form"), please read the terms and conditions. If you have questions concerning this, please ask before entering a contract with us.

These Terms together with our booking confirmation (whether oral or written) shall constitute the contract (“Contract”) between us for the supply of Services to you.

1. Health Check

1.1 Purpose of the Health Check

Before we provide our Services, we require that you complete a Health Check and other mandatory forms. A Health Check consists of 3 parts:

1.1.1 Your completion of a form: We will ask you to complete a form or list of questions (the Health Check Form). This will record details, as stated by yourself, as to your current state of health, any medical conditions you have and any medication you are taking.

1.1.2 Our evaluation of various health indicators: We may carry out an evaluation of certain indicators of your health including your blood pressure, heart rate, basic metabolic rate and body mass index. We may also ask you questions concerning your diet, the type and number of exercises you take (and have taken in the recent past) and your general lifestyle. This information will be added to the Health Check Form.

1.1.3 Development of a training and exercise programme: Based on the results of clauses 1.1.1 and 1.1.2, we will discuss the type of training and exercise programme you would like to (and can) follow. 

1.2 On completion of the Health Check

On completion of the Health Check, if the form is being completed in hard copy we will ask to you sign the Health Check Form to indicate that the information you have provided, and what has been agreed and stated in the form is recorded accurately. If being completed online your completion of this form constitutes to your agreement that everything stated in the form is recorded accurately.

1.3 Further points

Please note that after the Health Check has been carried out, we may not be able to provide any Services. For example, if any form of training or exercise we can offer is not suitable for you or if the form and type of training and exercise you require is not medically safe for you to undertake. In such cases we may require you to consult with a medical doctor (such as your GP)

 

2. Performance of the Services

2.1 We either provide our Services based on individual classes or a series of classes depending on what Services you elect. This may also include private client work. However, the best results or benefits are usually only possible if a series of classes are booked.

2.2 It is not possible that any particular result or outcome can be guaranteed because of us providing our Services. Our aim is to provide the Services:

2.2.1 by using reasonable care and skill; and

2.2.2 to comply with commonly accepted practices and standards of the Register of Exercise Professionals.

3. Facilities

Normally the Services will be carried out at our place of business. It may also be carried out outdoors, via Zoom or at a private residence.

 

4. Length of a Class or Private Session

Our Services are provided in classes or privaye sessions normally given between 30 minute to 55 minute time slots (Class(es)). A few minutes at the beginning of each class is required to set up, ask you any questions about your condition, any issues or problems etc and allowing you time to get ready to start and leave etc.

 

5. Stopping a Class

At any time during a class if in our opinion we consider that:

5.1 you appear to be unwell or becoming unwell; and/or

5.2 you appear not to be following our reasonable instructions (such as not following instructions intended to protect your, our or another person’s safety); and/or

5.3 you are behaving or acting unreasonably or are offensive, then we may wish to stop a Class and not continue it.

6. Booking and payment

6.1 We offer an online booking facility via our website and Momence booking system. This shows the availability of classes on the date and time you select and payment options. For private sessions booking and payment is made via email and bank transfer.

6.2 Payment

You can pay for classes either by credit or debit card. We may also offer other payment facilities through our booking agent via our website. If you have booked a block of classes in the form of class packs, then payment will be made for all the classes booked.

6.3 Payment must be made in advance of any class or private session. If payment has not been received prior to the class, the class will be cancelled. For any 2:1 or private group classes, payment in whole must be paid to BASE. We will not accept individual payments from participants.

6.4 Class bookings

Each of our class packs have an expiry date which is clearly detailed in the terms of each of those class packs. Class packs are not extendable or transferable, therefore if you are unable to use all your sessions in the pack before the pack expiry date, we will not refund you. So please bear in mind when making your purchase whether a class pack or single class pass is more appropriate for your needs.

7. If you are late for a Class or cancel

7.1 If you are late

If you are late arriving to a class or if you have chosen the location of the class and it is not ready at the scheduled start of a class, then the class will start when you arrive, or the location is ready. The class will continue until its scheduled end and no additional time will be given to account for any delayed start.

7.2 If you cancel

You must register for all classes you wish to attend by visiting our Timetable page on our website or our schedule page on our Momence booking system. Once you have bought your class pass or your class pack this does not mean you have booked onto a class - you must book onto the class separately.

7.3 You are able to book onto any class up to 14 days prior to the class date and no less than 2 hours prior to the class start time. You may also cancel anytime within the 14 days prior to the class and up to 24 hours before the class start time. For any cancellations made less than 24 hours prior to the class start time, the full 100% class cost will be deducted from your class pass / class pack or will not be refunded to you, if you have paid in advance. The same applies to private sessions where a cancellation is made less than 24 hours prior to the session time. For classes there is also an additional penalty fee for late cancellations or ‘no-shows’, whereby you will be charged if this happens 3 or more times within a 28 day period.

7.4 If we cancel

On occasion we may have to cancel a scheduled class. This may occur because of a number of reasons, such as that a trainer is unwell, or a preceding class has overrun, or we cannot reach the location where we have a scheduled class because of travel problems (traffic jams, etc). If a cancellation occurs in this situation, then we will offer you another scheduled class without further charge to you or offer you a refund of my fee for that scheduled class.

 

8. Booking Liability

8.1 A binding contract between us is not formed until we accept your offer to make a booking for a class or a class pack. An offer will be deemed to be accepted by us once you are in receipt of a booking confirmation from us.

8.2 All classes are offered by us subject to availability.

8.3 Notwithstanding, the above in this clause 8, in the event of any errors or omissions by us via our website or our booking system, we reserve the right to cancel all class bookings. In the event of such cancellation, our liability to you shall be limited to either a refund or credit for the class cancelled.

 

9. Our general liability to you

9.1 We shall not be responsible for any particular class, any fitness instructor and / or any equipment supplied by us, not being available for any reason.

9.2 Our liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount having regard to such factors as whether the damage was due to a negligent act or omission by us. Our liability for death or personal injury is also subject to certain limitations which are set out in clause 9.3.

9.3 Limitation and exclusion of liability for personal injury and death

We will compensate you for any loss or damage you may suffer if we fail to carry out duties imposed on us by law (including if we cause your death or personal injury to you by our negligence) unless that failure is attributable to:

9.3.1 your own fault;

9.3.2 a third party unconnected with the provision of Services under this contract; or

9.3.3 events which we could not have foreseen or forestalled even if we had taken all reasonable care.

9.4 In consideration of your participation in our classes and any programmes scheduled by us, and in consideration of the use of our facilities and/or equipment, and subject to clause 9.3, you hereby waive and release us from all responsibility for any injuries or damages resulting from any of our activities or use of our equipment or facilities.

 

10. General

10.1 What to bring with you:

10.1.1 Please wear comfortable sportswear, trainers and for studio sessions please wear socks (grippy if possible); and

10.1.2 Please bring your own yoga mat and a bottle of water.

​10.2 Arrival at the studio: 

We LOVE that so many of you are keen to come in and get started on arrival. If attending our BASE SPACE Studio, we have a lovely seating area on the first floor hallway landing so please take a seat there and we will come and welcome you inside at the start of your session. If you are early for your class or see that we aren’t with clients, please do still wait in the hallway – we have very minimal time between clients and we cherish these moments of downtime to catch up on work as well as having a little break ourselves – so that we can bring our A-Game to your session!

10.3 What to do if you are unwell: 

We love your commitment to exercise, but if you are unwell, please do not attend your class in person with us. We are a small independent business, and we work closely with vulnerable individuals. If you attend a session unwell, we have full discretion to ask you to leave, and your session cost will still be deducted.

10.4 Personal Belongings: 

Your personal belongings are your own responsibility. If attending our studio, please leave your coats and shoes in the hallway where you will find wall hooks and under bench cubes for shoes. This will prevent the studio from getting muddy and slippery. Of course, please feel free to bring bags or precious items in with you; - we have the white cubes for you to pop those into.

BH12 3BA. If we wish to send you a letter or notice, we will use the address you have given in the Heath Check Form.

 

12. Contracts (Rights of Third Parties) Act 1999

For the purposes of the Contracts (Rights of Third Parties) Act 1999 this Agreement is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.

 

13. Force Majeure

13.1 We shall not be liable to you or deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of our obligations under these Terms, if the delay or failure was due to any cause beyond our reasonable control, including, but not limited to, Acts of God, explosions, pandemics, epidemics, fires, acts of war, power outages, sabotage, floods.

 

14. Disputes

If you are unhappy with the Services, we provide we hope you will discuss any problems or issues with us first. In addition, or alternatively, you may wish to contact CEDR as they offer a mediation service which can help resolve disputes. If you wish, you may, at any time, take court proceedings. If so, you must do so within the courts of England and Wales. This contract is governed and construed by the law of England and Wales.

 

15. Data Protection

We are committed to ensuring that we comply with all relevant data protection laws including GDPR and the Data Protection Act 2018. We therefore ask you to review our privacy policy and the terms which are hereby expressly incorporated by reference.

 

16. Disclaimer

16.1 We do not give medical advice or provide any healthcare services. However, if necessary, we may recommend that you seek professional advice from a doctor or other medical practitioner. There are inherent risks associated with exercise and fitness programs and you therefore engage in these activities with us, at your own risk. You are expressly prohibited from using our Services if you have been advised not to by a doctor or medical practitioner.

16.2 You acknowledge that your diet and exercise activities are also relevant, and you take full responsibility for your health, life and wellbeing.
